Child Custody
Child custody refers to the rights and obligations between parents, regarding their children, after a divorce, legal separation, or paternity decree. There are two independent types of custody. Physical custody refers to the amount of time each parent is permitted physically with a child. This may be sole, primary, or joint custody. Legal custody refers to a parent’s decision-making rights regarding a child’s health, education, and welfare. It, too, may be sole, primary, or joint custody.
Child Support
Regardless of your fight to gain custody of your children, child support will be an issue in your case. You will either be paying it or receiving it. Courts have little discretion in setting the amount of child support to be paid. This is because, as a condition of receiving federal aid, the states are required to follow certain standards in their child support statutes. Although the exact procedures and details vary from state to state, there is a certain basic pattern no matter where you live.
Contempt Proceedings
Contempt can only come into play after a court has issued judgments, orders or decrees to govern the behavior of the parents, which it can do at any point during the divorce proceedings. Once a court has issued such decrees, it is important for you to observe them to the best of your ability and, at the same time, to take note of any potential violations on the part of your ex-wife or former partner. Courts have been known to take it personally when a parent disregards their orders.
Establishing Paternity in a Divorce or Child Support Case
When the parents of a child are not married at the beginning of the pregnancy or at the birth of the child, the father is legally without the rights and responsibilities of a parent. The father, mother, or a third party on behalf of the child, must seek a declaration of paternity to legally establish a parent-child relationship with the father. This process gives the father specific custodial rights while imposing upon him a legal obligation to provide specific financial support for the child.
Legal Separation
(In states where permitted.) Legal Separation is a court process designed to define the important rights and obligations between spouses when they live apart, but do not want divorce. The decree for legal separation establishes rules between the spouses regarding such issues as child custody, visitation, and spousal maintenance (alimony). It also divides property and usually debt. However, unlike divorce, the marital bonds are not severed and the spouses continue to be husband and wife. If, at any time during the legal separation, or thereafter, either spouse believes that the differences between them are irreconcilable, he or she may file a motion to convert to a dissolution of the marriage.
Military Family Law
When a couple decides to end their marriage while one spouse is serving in the military, divorce tends to get more complicated. There are specific rules about where to file for divorce, how to calculate child support, how to determine child custody, how to divide retirement benefits, and more that you need to know. At Cordell & Cordell, we understand the unique challenges military families face during divorce. Our attorneys are able to handle these cases to ensure that your rights and the rights of your children are protected.
Power of Attorney
Sending your child off to college is an exciting experience, but it also brings a lot of stress. As a divorced parent, you have enough to worry about without being concerned about having access to your son or daughter’s educational, medical, financial, and other critical information.
Property Division and Asset Division
Every marriage has at least one topic in common – property. Whether they own a million-dollar mansion or a beat-up RV, a couple will always have to divide up the property and debt. Certain assets remain the exclusive property of one of the marriage partners, even after marriage, and some will be divided. This is done with debts as well. Most debt incurred while married will be shared upon dissolution, though a few personal debts may remain exclusively yours.
Protection Order
Protection orders are unfortunately common in family law cases and are often used for strategic reasons. The misuse of a protection order when going through a divorce is one of the more prevalent and unfortunate trends in family law. A system that was designed to protect against abuse is itself being abused.
Spousal Support, Alimony, Maintenance
In some instances a wife will ask for alimony, the court-ordered payment of money to your wife after the dissolution of marriage. If you made more money (especially if you were the primary breadwinner), there is a good chance your wife will seek alimony. The bigger the difference in earnings and the longer you were married, the larger the alimony payment will be.

There are only positive things to say about Cordell and Cordell, especially Diana Megalla. She has been my attorney for several years and has helped me so much with the entire divorce process. Diana is an excellent listener, and she is so talented at helping others look at the entire slate of options available in any particular situation. I appreciated that most about her. She was also readily available and always up to talk, brainstorm, or strategize. She is honest and straightforward as well. Divorce is among the most stressful and traumatic experiences for anyone and Diana was there to help for every part of it. I would highly recommend Diana to anyone that is going through a divorce. She’s the best.

I was represented by Lauren Hagovsky during my divorce and subsequent custody settlement and cannot say enough great things about Lauren and the rest of the firm. Divorce sucks, especially as a male, where you’re fighting an uphill battle it feels from the start. I did not feel that way with Lauren, she was incredibly knowledgeable and tactful and always went out of her way to ensure I knew all of my options, prepared out game plan and was always thinking ahead on our next possible moves. The end result is that I am the primary for my kid and got extremely favorable and very fair terms within the divorce agreement. I would not have been able to get that done with any other attorney nor with any other firm.

I was represented by Anthony Paolini for a divorce and I am incredibly satisfied with his counsel throughout the entire process. Anthony was always available, immediately knew the status of my case when I would call, and provided solutions and sound legal advice for some unique issues. I was only able to navigate the divorce process and all of the issues and stress that come with it thanks to his counsel and I strongly recommend giving him a call if you have any New Jersey family law concerns.

Cordell & Cordell, and particularly, Anthony Paolini within the office at Mount Laurel, NJ is an excellent attorney who provides sound, vigorous, and enthusiastic representation even under very challenging legal circumstances. My divorce involved complex jurisdictional matters and required legal representation in different states, and the corporate structure of their company allowed for this litigation to be handled with care and as efficiently as possible. Although one may sometimes have unrealistic expectations during a divorce, he will try to achieve any desired aims, but also simultaneously be realistic concerning anticipated outcomes and how best to achieve both a cost-effective and desirable resolution. During my complex case, he consistently demonstrated thorough knowledge of NJ family case law and a responsiveness to my needs and desires throughout the entirety of the process.
