All of the actions described in the definition of assault are considered a class A misdemeanor, but these charges can be increased to felony charges under certain circumstances.
Assault Family Violence
Assault Family Violence Charges
Texas also has laws against “family violence.” The term is defined to include a member of the family or a member of the household, whether the person is related or not. This means assault against a live-in girlfriend or boyfriend is considered family violence – even though the person isn’t a member of your family, they are a member of your household.

Burglary Burglary
Burglary Charges
Burglary is also sometimes referred to as breaking and entering (b & e) or housebreaking which is less confusing for people because it implies the act of breaking into a building, rather than the act of taking property.
Capital Murder Charges
You can also be convicted of capital murder if you kill more than one person at the same time.Capital murder is a capital felony. It is punishable by death via lethal injection or a life term in prison without the possibility of parole. In some cases, if a judge does not believe capital murder was proved beyond a reasonable doubt, that judge may decide to downgrade the charge to a lower felony offense.

Criminally Negligent Homicide Charges
Like manslaughter, a charge of criminally negligent homicide is less serious than murder. But while manslaughter pertains more to reckless actions, criminally negligent homicide is defined by carelessness. Essentially, in Texas, you must conduct yourself and your business in a way that does not bring harm to others. If you neglect to do so, you could be charged with a crime. Punishment for criminally negligent homicide is a state jail felony. This charge carries a fine of up to $10,000, or a term in state jail for 180 days up to 2 years, or both.

How a Denton County TX Criminal Defense Lawyer Can Help
Accusations of child abuse can be especially heartbreaking – no one wants to put a child through a painful and traumatic situation like going to court. But at the same time, the claim must be investigated thoroughly if the person accused is to be charged with the crime. At Tress Law Firm, we understand the enormous hurdle you are up against. We can provide the balance you need by fighting ruthlessly in court for your rights, but working to ensure that the relationship between you and the child remain connected. Call us today to discuss your case.
Indecency With A Child Charges
A person who comes into contact of a sexual nature with a child, such as fondling or groping, can be charged with indecency with a child. If a person coerces the child to engage in sexual conduct, that person can still be charged. Additionally, you can be charged with indecency if the child is younger than 17, whether you knew the child’s age or not.
Injury To A Child Charges
Injury can be done to a child in a mental or emotional capacity. Emotional and mental injury can have a marked effect on the child’s psychological or physiological growth. The child’s caregiver can be accused of administering mental or emotional injury or allowing the child to be subjected to another party that subjects the child to emotional or mental abuse without putting a stop to the abuse.

Manslaughter Charges
Manslaughter, while still very serious, carries a slightly lesser charge. A person commits Manslaughter when their reckless actions cause the death of another person. What makes manslaughter different than murder in the intent – in a murder case, the person accused intended to kill the deceased. In manslaughter, the person accused did cause the death, but their actions were more accidental, not intentional. A manslaughter conviction results in a 2nd-degree felony punishment.
Manufacture or Delivery of Controlled Substance Charges
You can be charged with a drug offense if you manufacture or deliver a controlled substance found in one of the penalty groups. You can also be charged if you possess a controlled substance with the intent to deliver it. The charge depends on which penalty group in which the drug is classified and how much you have on you.
Murder Charges
Murder is a 1st-degree felony charge, which means the court can sentence you to state prison for 5 up to 99 years or fine you up to $10,000, or both. But it is possible to get a lesser charge if the crime was committed in “sudden passion.” Sudden passion means the person who was killed provoked the person accused, and the person accused acted on behalf of their emotions, not with any practical thought. It’s important to note that the “lesser charge” in this case is a 2nd-degree felony, which carries a fine of up to $10,000 or a prison sentence of 2 up to 20 years, or both.
Negligent Homicide
Possession of Marijuana Charges
Marijuana is in its own group; it is not included in any of the penalty groups. But like the penalty groups, a charge for possessing marijuana depends on the quantity you have. For purposes of the statute, THC wax and edibles are included as well.
Possession of a Controlled Substance Charges
Possessing a controlled substance without first obtaining a prescription from a qualified healthcare professional is a punishable offense. The penalties range depending on the groups and amounts.
Possession to Manufacture Controlled Substances Charges
It’s an offense to possess certain chemicals with the intent to manufacture a controlled substance.

Robbery Charges
Robbery is the act of taking something either with the use of force or by threatening to use force. When a weapon is used during a robbery, it is called either aggravated robbery or armed robbery. Therefore, under Texas law, the theft of a purse is classified as robbery, whereas use a weapon to persuade someone into giving up their purse is classified as armed robbery.

Sexual Assault Charge
Sexual Assault Charges
Sexual assault is a second-degree felony charge. If convicted of sexual assault, you could be fined up to $10,000, or sentenced to a term anywhere between 2 and 20 years in a Texas state prison, or both. In some instances, sexual assault is a first-degree felony, which carries a fine of up to $10,000 and a prison term lasting from 5 up to 99 years. The first-degree felony charge is for people who sexually assault a person they claim to have married but to whom they are not legally married, such as an instance of bigamy.
Sexual Assault Of A Child Charges
Sexual assault of a child can involve sexual contact as described above, and can also refer to penetration or intercourse with a child. Sexual assault on a child is a 2nd-degree felony offense.

Weapons Charges
According to the state of Texas, felons are allowed to possess a firearm in the home in which they reside. They are only allowed to possess one after a certain amount of time. The time in which they may have a firearm is five years from the date his sentencing was thrown out and or discharged. If they are found to have a firearm before the five year period is up, they can then be charged with unlawful possession of a firearm because they violated and or broke the law. In terms of this law, it is considered legal by the state. This does not apply to federal law though. For example, if there was a raid of the premise by the FBI, the felon may then and can be charged and convicted under the federal statute and or law.

Highway Angel
January 2020 (right before Covid shut everything down) we retained Ms. Tress to handle 2 very serious felony charges against my husband. Ms. Tress was great to work with and I am sure she got frustrated with my husband (and probably me as well) with asking questions, sometimes more that once because we didn’t understand why certain things did or did not happen and why the case made it as far as it had and why it was taking so long to either get it dismissed or to trial to get it over with so that we could try to get on with our life and not have to stress about it because when we retained Ms. Tress, our issue before my husband’s arrest started in 2018. My husband told Ms. Tress from the start that we would have to go to trial if the DA doesn’t drop or dismiss the charges because he would never take a plea offer because he is innocent and by taking a plea, he would be admitting guilt to something he did not do. Long story short, almost 3 years after my husband’s arrest and the stress, anxiety, worrying, and plenty of tears and getting ready for trial that was to being this week, Ms. Tress called us last Thursday and informed us that the DA is dismissing the case. THANK YOU MS. TRESS for being patient with my husband and I. I am sure we were probably hard to deal with at times and not understanding some things and questioning things and you probably questioned why you took our case but we are so thankful for all that you have done and so grateful that we got the results we wanted even though it really isn’t over until we clear his record but again. Thank you and for anyone reading this, you will not be disappointed as Ms. Tress is knowledgeable, patient and will do all she can to get the best results for your situation.
