Probate or Estate Administration
When a person dies without a trust, or if a trust is not properly funded, their estate usually needs to be administered through the courts. That process is called “probate”, which literally meaning “proving the will.” There are some exceptions to the requirement of formal probate proceedings, but an estate must be carefully evaluated to determine whether the exceptions apply. Power of Attorneys expire at the death of a person and should not be relied on for purposes of estate administration. Persons unsure of whether they are properly handling an estate should contact an attorney. Attorneys fees and costs are determined by statute and paid out of the estate, usually at the end of the administration. T.Burd Law Group, APC can evaluate a person’s estate and administer the estate through probate.
Probate or Trust Litigation
The probate code sets forth very specific requirements that persons handling a probate or estate must follow. If an executor, agent with power of attorney, or trustee has misappropriated assets or otherwise failed to follow the law, the beneficiaries may have a cause of action against them. A trustee or estate administer may also need to file a claim against another person who took assets from an elderly person or decedent when they did not have the right to. Because these types of actions involve Trusts or the Estate of someone who is now deceased, the probate code applies. It is sometimes difficult to know whether a claim should be filed in Probate court, Civil court or both, and it’s important to have legal counsel to make sure all rights and remedies are preserved. There are also short time limitations in these matters that should be monitored carefully.
