Appellate Litigation
Florida Trial Lawyers ADVOCATES WHEN YOU NEED US THE MOST CALL US AT 1-407.648.1700CMGPA represents clients in civil and criminal appeals, as well as post-conviction cases, in both state and federal court. Our attorneys have represented clients in appeals to Florida’s Circuit Courts, to the District Courts of Appeal, to the Florida Supreme Court, and to the Federal Circuit Courts of Appeal. We bring our extensive knowledge and understanding of civil and criminal trial matters to our appellate cases. Not only are our attorneys adept at identifying errors in the procedures employed prior to and during trial, but our knowledge of multiple practice areas allows us to recognize substantive errors of law made at trial. The proper appellate presentation and argument concerning such errors may lead to reversal of the trial court’s final judgment.Whether your case is civil or criminal, it can be devastating to have a final judgment entered against you. It can mean that the opposing side has the right to collect vast sums of money from you or your business, or that you have lost your home, or even that you will serve time in prison. These and many other potential outcomes can be life-changing. Our attorneys are dedicated to helping those parties whose rights are threatened or impaired because of some trial court error, in order to “right the wrong” and protect the rule of law. Moreover, our firm considers the big picture. Some errors made during trial are best presented on direct appeal, while others are more properly presented in a post-judgment, collateral attack in the trial court. Our experience in appellate and post-conviction matters allows us to evaluate and employ different strategies in different cases. We do not take a “cookie cutter” approach. We consider the best course of action for every client on an individual and case specific basis with one essential goal in mind: winning.CMGPA is dedicated to finding and presenting the best legal arguments for our clients. We use our passion for justice to help put our clients in the best position possible to obtain a reversal of a wrongly entered judgment. We are here to help parties understand that a final judgment does not have to mean that the fight is over.Criminal AppealsA final judgment of conviction can be devastating to you and your loved ones. Whether you are sentenced to an extended term of imprisonment or a term of probation, a criminal conviction can wreak havoc on your future. It is therefore critical that every reasonable effort be made to attack the conviction on appeal. Thus, we represent clients in a wide variety of criminal appeals, from misdemeanor cases involving probationary sentences, to felony cases involving life sentences. No matter what the charge or what the sentence, we understand that every case is unique. We take the time to research and debate potential legal issues. We try to explore every avenue possible to get relief for our clients. Not only do we use our knowledge and experience to advance legal arguments on appeal, we also involve our clients in the process. From the outset, we thoroughly discuss the case with our clients, so that we understand the facts, and so that they understand the strategies and options available to them. Ultimately, it is our clients who decide how to proceed.Post-Conviction MattersSome arguments cannot be made on direct appeal. Instead, they are properly raised in a post-conviction or collateral attack of the final judgment and sentence. Having an attorney who understands the sometimes subtle distinctions between these separate challenges is critical to ensure that a party’s time, energy and money is not wasted litigating the wrong claim in the wrong court, through the wrong process. Our attorneys understand the critical differences between appellate arguments and post-conviction arguments and the types of legal arguments it takes to win at each level. We handle criminal appeals, post-conviction matters, and matters involving federal review of state court judgments, including federal petitions for writs of habeas corpus. Our experience in these areas helps us to protect our clients’ rights to the fullest extent possible. We understand the time frame applicable to each stage of review. We also understand that substantive arguments must be preserved in order to be raised at the next level. We consider the bigger picture when attacking a judgment and sentence, and strive to ensure that our clients have an opportunity to challenge the judgment and sentence at every possible stage.Civil AppealsAt CMGPA, our civil appeal cases have the benefit of being overseen by a board certified Civil Trial expert, Charles M. Greene. We combine our experience in appellate litigation with Mr. Greene’s civil trial expertise to identify errors of law made at tri

Business Litigation
Florida Trial Lawyers ADVOCATES WHEN YOU NEED US THE MOST CALL US AT 1-407.648.1700Business LitigationBusiness litigation is never simple, and never comfortable. In some cases, particularly disputes involving closely-held companies, lawsuits can degenerate into unreasonable and meaningless battles. One of our roles as a counselor to those involved in business disputes is to help our clients formulate reasonable goals and maintain their focus so that their emotions do not override their reason.Complex business disputes can involve multiple parties, counterclaims, cross claims, and related claims in litigation pending in other federal or state courts. In addition to being emotionally draining, business disputes involving securities, business torts, trade secrets, employee theft, unlawful competition, and the like can tax company resources to their limit. It is, therefore, important to retain sophisticated counsel with experience in business disputes so that you can discuss and determine your goal(s) and strategies before undertaking the prosecution or defense of a business related claim. In addition to being able to wade through the morass of procedural rules and regulations, experienced business litigation counsel will help you see the “bigger picture” and the often unforeseen adverse effects that can result, for example, if you engage in a discovery battle which reveals confidential information that could undermine your business. At CMGPA, we hope for the best but plan for the worst. Anticipating the otherwise unforeseen can bring great rewards and help avoid great tragedies. Sometimes it is better to lose a battle so that you can still win the war.Complex Corporate & Business LitigationWe routinely handle cases involving breach of contract, business torts, shareholder disputes, employment matters, civil RICO actions, business fraud, shareholder derivative suits, unfair competition, breach of fiduciary duty, and other corporate and business matters.Securities LitigationWe handle securities fraud cases involving private parties and also defend actions brought by the Securities Exchange Commission, Commodities Futures Trading Commissions, and State agencies.Trade Secrets LitigationWe routinely handle cases involving alleged thefts or other dissipation of trade secrets by employees and others.Employment LitigationWe defend and prosecute cases involving violations of covenants not to compete, theft of confidential and proprietary materials, and other violations of fiduciary responsibilities by former employees, as well as breaches of employment contracts.Probate & Guardianship LitigationWe have represented clients in a variety of probate and guardianship matters.Landlord & Tenant DisputesWe represent residential and commercial landlords in a wide variety of matters, including evictions and disputes over the breach and interpretation of lease provisions.Business AdviceWe provide business counseling with respect to actual, threatened, and prospective litigation in a variety of circumstances to help companies and individuals limit their potential liability, risk, and expense.

Florida Trial LawyersADVOCATES WHEN YOU NEED US THE MOSTCALL US AT 1-407.648.1700We offer efficient, innovative and practical legal solutions for our clients needing Criminal Defense:Criminal RepresentationWhite Collar Crimes, Drug OffensesA criminal conviction in Florida could lead to an array of penalties that can negatively affect your life, future, and members of your family.Depending on the nature of the crime, you could face: jail time, probation, community service, hefty fines, and other harsh penalties. In addition, your criminal record could make it difficult to find or maintain employment, a place to live, obtain credit, and other life necessities. If you are accused or charged with committing a criminal act, don’t risk your future. Contact an experienced criminal defense attorney who understands the law and will protect and defend your rights. Our firm is committed to defending and protecting the rights of individuals accused or charged with misdemeanor or felony crimes. For years, we have helped countless clients obtain favorable outcomes. Our firm is experienced in criminal law and is familiar with the Florida legal system. We will take the time to investigate each case, review the charges and formulate a strategy to pursue the end results you need.Criminal DefenseOur firm represents clients in a variety of federal criminal matters, and particularly in “white collar” cases involving alleged RICO, fraud, theft, tax, and securities law violations. The criminal practice of the firm also includes the representation of clients facing drug charges, both in federal and state court, as well as the defense of clients facing a wide range of felony and misdemeanor charges in the Circuit and County Courts of Florida. We have a reputation for ethical and fair dealing with the federal and state prosecutors with whom we deal. We have an equally strong reputation for being extremely thorough and a formidable opponent in those cases that cannot be resolved without a trial.Range of CasesCharles M. Greene, P.A. represents clients who are suspected, accused, and charged with crimes in both State and Federal Courts. While our background makes us eminently qualified to handle white collar, document intensive cases, we also represent many clients accused of major and minor drug offenses, theft, immigration violations, domestic violence, and many other different felonies and misdemeanors.Complex CasesThe infrastructure and technology that we have purchased and developed for our commercial litigation practice makes us well suited to handle document intensive criminal matters which most criminal defense lawyers avoid. Charles M. Greene, P.A. has handled many cases against federal agencies that involved thousands and sometimes hundreds of thousands of documents that had to be sorted, analyzed, indexed, and stored so that they could be used at trial and/or at other appropriate points in the litigation process. The key to a solid defense is often hidden in voluminous documents which must be mined for the nuggets they may contain. While it can be a grueling and tedious process, this sort of labor-intensive investigation is essential to a competent defense of cases involving alleged Ponzi schemes, tax fraud, securities or commodities violations, mortgage fraud, and the like.White Collar Criminal DefenseThe term “White collar” crimes generally refers to non-violent offenses involving money and/or financial transactions. Corporations, executives, and professionals are increasingly the target of aggressive criminal prosecution and regulatory enforcement of white collar criminal statutes. For persons who find themselves the subject or target of such efforts, we offer vast experience in avoiding and defending prosecution.Personalized Representation & CounselingWe recognize that the prospect of criminal prosecution is extremely stressful and blurs one’s judgment and ability to think clearly. We are there to help counsel and guide you through the process. We will listen to you, try our best to understand and address your concerns, and educate you as to what has happened and what may happen as your case goes forward. Your worries become our concerns. Let us handle them for you. Do not make a bad situation worse.Every Case is UniqueYou are not just another number or statistic. Every criminal case is different and unique. The people and the circumstances always vary. At Charles M. Greene, P.A., we try to understand the “big picture,” how you may have arrived at this juncture in your life, and how you can best move forward.Communication is KeyListening is a big part of the communication process. We will listen to you, and you should listen to us. We will try our best to explain the charges that have been filed or that you may otherwise face, how they apply to the facts and circumstances at issue, and the most appropriate defense strategies.

Charles Greene in my opinion did a terrible job representing us in a recent law suit. To prepare us for an important deposition he showed up an hour later then his scheduled time leaving 5 minutes to prepare us. He showed up looking very unprofessional in jeans while all the other attorneys were in nice dress attire. This obviously lead to a bad outcome.
