Many people are under the false impression that OWI cases are impossible to defend, that if you are over the legal limit, you are guilty and there’s nothing to fight about. Cases can be attacked from a number of different angles. Suppression of the Evidence Police offers have to have a reasonable suspicion to stop you and probable cause to arrest you. If the officer pulls you over for an invalid reason, or gives you a PBT without establishing probable cause to believe you are OWI, or does any number of other things wrong before gathering evidence against you, he may be violating your rights. All procedures in an OWI case must be followed, and if they are not, the evidence against you is subject to possible suppression. There are dozens of ways that the police can make mistakes that result in suppression. Suppressed evidence means the prosecutor cannot use it against you.

Felony Defense
A felony is a criminal offense for which a convicted person can be sentenced to serve one or more years in a state or federal prison, pay fines or both. Felony crimes are distinguished from misdemeanor crimes by the possible sentence provided in the statute: if the possible prison sentence is one or more years, the offense is a felony. Otherwise, it is a misdemeanor. A person can be sentenced to death for a felony conviction in states where the death penalty exists; Wisconsin does not have the death penalty. The team at Cohen Law Offices has over 30 years of experience defending the rights of people who have been charged with felonies. When the stakes are high, you need an attorney who has the experience, skills and persistence to advocate on your behalf. Call Cohen Law Offices.

Misdemeanor Defense
Misdemeanors and Their Penalties Under Wisconsin law, misdemeanor charges are categorized according to their severity.Class B misdemeanors may include a fine of up to $1,000, imprisonment for up to 90 days, or both.Class C, on the other hand, may include fines up to $500, imprisonment for up to 30 days, or both. Felonies and misdemeanors both involve imprisonment. However, felonies get you sent to a state or federal prison. A person convicted of a misdemeanor is sent to a local or county jail. Work With the Local Professionals Your overall quality of life depends on having a good verdict for your misdemeanor. We can help you fight off your charges and help you achieve a better verdict. This could greatly facilitate your ability to find future employment and avoid jail time.
OUI Defense
If you have been charged with OWI, the state is already in the process of suspending your license. Should you fail to challenge the administrative suspension within the required time period, the suspension will become effective for six months. Cohen Law Offices can fight your driver’s license suspension. OWI and DUI defense lawyer Michael Cohen & team understand Wisconsin’s drunk driving laws and know how to fight OWI charges. We have obtained dismissals and not-guilty verdicts in numerous OWI cases. If you have refused a breath test, their work as OWI defense attorneys is that much more important. Cohen Law Offices have won cases where their clients refused the breathalyzer test.
OWI Defense
Challenges to the Field Sobriety TestsThe field sobriety tests are the evidence the officer uses to establish probable cause to arrest you, and also provide evidence at trial that you were too impaired to drive. These tests have to be given by the officer precisely according to the instructions; even then, they are only accurate a relatively small percentage of the time in showing a person is overthe limit. The Curve Defense The law is you can’t be over the limit at the time of driving. If you took a drink right before you drove and were stopped shortly thereafter, that last drink wasn’t in your system when you were driving, but would have absorbed by the time of the test. That means the reading on the machine is higher than what your BAC really was at the time of driving.

Sex Crime Defense Lawyers in Eau Claire Unfortunately, the prevailing attitude among many in sex crime cases is “guilty until proven innocent.” It is important to have an attorney who is skilled at handling serious sex offense allegations with both zeal and discretion. Because of the stigma attached to sexual offenses, many unstable or unscrupulous people will falsely accuse a family member, neighbor, teacher or someone else they don’t like of committing a sex crime. Sometimes, prosecutors unknowingly rely on false statements and testimony. The results can be devastating, even if the person is found to be innocent. In addition to prison time, lifetime registration as a sex offender can ruin a person’s life. Under Wisconsin law, an individual convicted of most sex crimes is required to register with the local police on their birthday every year for the rest of their life and every time they move to a new city. There are specific discovery requests that need to be made in sex crime case

Student Defense
It’s bad enough to get charged with a misdemeanor or felony. It’s even worse when you’re a student. Students are in a transitional period of their lives. They often depend on their current institutions and jobs to have a future to look forward to. Criminal charges can do more than just inconvenience students. If you’re found guilty, you could face eviction from your school. This can be catastrophic for students. Here at Cohen Law Offices, we make it our top priority to safeguard those in legal need. No one has more need of our services than a student in a legal bind. Consult with us to prepare a defense for your charges. Your future may depend on it.

Positive: ProfessionalismWe hired Michael in December of 2018 to represent our son. My sons trial took place July of 2021. My son was found not guilty. I am confident in saying that had we not hired Michael, my son’s outcome would have been very different. Michael has a full-time private investigator on staff to do investigation. He will hire other experts, as needed, depending on your situation. He told my son, “I only hire the best.” As the client, you do have to pay for these experts. Or, you have the option to not pay the extra money for the expert. If Michael is recommending an expert for your case, I’d hire them. We hired two experts who testified for our son. These doctors had so many degrees and accreditations that I cannot even begin to list them all. Both are highly intelligent and accurate in their testimony. If you’re taking the time to read this review, you must be in need of a criminal defense attorney. There is no worse feeling than finding out your child is being accused of something they are adamantly saying they did not do. If you find yourself or loved one in this horrific situation, hire Michael Cohen. He will work tirelessly for you. He will be thorough. He will walk you through the process, step by step. He is quick to respond to questions. He returns emails in a timely manner. He has genuine care and concern for his clients. I’m thankful that we found him and hired him. Is he expensive? Yes! But ask yourself this: how much is your life or your loved ones life worth?? Spend the money! Hire Michael. He’s a fantastic attorney. We hired Michael in December of 2018 to represent our son. If I could give this attorney a zero rating I definitely would do so. Mr. Cohen defended me in 2019 in a case in which I was completely innocent of. He never gave me the opportunity to provide my side of “the story.” I paid him $15,000 and was given 10 minutes of his time a mere 3 times in which he told me, “I don’t care if you are guilty or innocent of these charges.” He never allowed me even 2 minutes of his precious time.

Critical: Responsiveness, ValueAbout a year ago, I hired Mr. Cohen to defend my brother on a drug possession charge. His case was complicated by the fact that he was advised by a court appointed lawyer in a previous case to plead guilty to a charge of drug dealing several years prior even though he was not a drug dealer nor has he ever been. He had been told at that time it was the quickest way to put it to rest and he wouldn’t go to prison if he pled guilty and he was anxious to make it go away. The possession charge came one week before he would have completed his probation from the earlier charge and his probation was revoked as a result and the court appointed attorney that represented him for that had just passed the bar a couple of months before. It seemed clear he needed a seasoned lawyer to represent him. I read the glowing reviews for Mr. Cohen and liked that everyone said he was very communicative about strategy and options so I thought he would do a good job for my brother. I was so impressed with Mr. Cohen in the beginning and he assured my brother he would get him out of the charges. When he stopped communicating with us that changed. Toward the end, he did not return emails or calls in which I presented questions about the case and what was planned and what was done. He also did not meet with my brother prior to court dates. He hired a professional to do a PSI and suggest favorable sentencing but she just recommended the same sentence that the DA suggested which was a shock since we were not informed before court of the recommendation. I wanted to also know why that was her recommendation. What was the point in presenting it to the court since it wasn’t going to help him. Just because it was paid for? In court the arresting officer lied on the stand more than once about why he destroyed evidence that may have proved favorable to my brother’s case and about why they were watching his house. Cohen expertly exposed the lies and we thought that would result in the case be dismissed but he didn’t even suggest it and they set another date to resume the hearing because they ran out of time. Mr. Cohen then told my brother should plead guilty and he wouldn’t get any more prison time. I think my $15,000 retainer must have ran out and that is why he wanted my brother to take a plea deal instead of pursuing dropping the charges since the arresting office lied about all of it. Yes, my brother made a mistake possessing a very small amount of meth that he should have declined when it was offered to him in appreciation of letting someone do their laundry at his house but he wasn’t an addict or even a routine user. But there was no real basis for their search of the property and we know of other cases where charges were dropped due to an unwarranted search. We had a hearing to try to get my brother released so he could get the medical attention he needed, his skin was gray and he felt like he was dying, but the jail would not address his concerns. The approach and lack of communication left us feeling like we didn’t get the representation I had paid so much money for. Maybe he did the best possible, but without any explanations from him it sure doesn’t feel that way. (I had to delete part of my review to make room for my update based on Mr. Cohen’s response. UPDATE: Mr. Cohen, my brother gave you permission to discuss everything with me so you can’t hide behind the “you were not my client” justification. He got the sentence YOU wanted because you advised him to plead guilty instead of having the case thrown out because the arresting officer lied repeatedly. You never explained to me why. I will forward to you all the emails I sent for which I got no response and if you can forward me the responses you claim to have sent, I will retract that claim (but there are none in my email account and I never deleted anything regarding his case) and appropriately update my review.About a year ago, I hired Mr. Cohen to defend my brother on a drug possession charge.
