Child Custody
Child custody refers to the rights and obligations between parents, regarding their children, after a divorce, legal separation, or paternity decree. There are two independent types of custody. Physical custody refers to the amount of time each parent is permitted physically with a child. This may be sole, primary, or joint custody. Legal custody refers to a parent’s decision-making rights regarding a child’s health, education, and welfare. It, too, may be sole, primary, or joint custody.

Regardless of your fight to gain custody of your children, child support will be an issue in your case. You will either be paying it or receiving it. Courts have little discretion in setting the amount of child support to be paid. This is because, as a condition of receiving federal aid, the states are required to follow certain standards in their child support statutes. Although the exact procedures and details vary from state to state, there is a certain basic pattern no matter where you live.
Contempt Proceedings
Contempt can only come into play after a court has issued judgments, orders or decrees to govern the behavior of the parents, which it can do at any point during the divorce proceedings. Once a court has issued such decrees, it is important for you to observe them to the best of your ability and, at the same time, to take note of any potential violations on the part of your ex-wife or former partner. Courts have been known to take it personally when a parent disregards their orders.
Establishing Paternity in a Divorce or Child Support Case
When the parents of a child are not married at the beginning of the pregnancy or at the birth of the child, the father is legally without the rights and responsibilities of a parent. The father, mother, or a third party on behalf of the child, must seek a declaration of paternity to legally establish a parent-child relationship with the father. This process gives the father specific custodial rights while imposing upon him a legal obligation to provide specific financial support for the child.
Legal Separation
(In states where permitted.) Legal Separation is a court process designed to define the important rights and obligations between spouses when they live apart, but do not want divorce. The decree for legal separation establishes rules between the spouses regarding such issues as child custody, visitation, and spousal maintenance (alimony). It also divides property and usually debt. However, unlike divorce, the marital bonds are not severed and the spouses continue to be husband and wife. If, at any time during the legal separation, or thereafter, either spouse believes that the differences between them are irreconcilable, he or she may file a motion to convert to a dissolution of the marriage.

Certain assets remain the exclusive property of one of the marriage partners, even after marriage, and some will be divided. This is done with debts as well. Most debt incurred while married will be shared upon dissolution, though a few personal debts may remain exclusively yours.

Protection orders are unfortunately common in family law cases and are often used for strategic reasons. The misuse of a protection order when going through a divorce is one of the more prevalent and unfortunate trends in family law. A system that was designed to protect against abuse is itself being abused.
Spousal Support, Alimony, Maintenance
In some instances a wife will ask for alimony, the court-ordered payment of money to your wife after the dissolution of marriage. If you made more money (especially if you were the primary breadwinner), there is a good chance your wife will seek alimony. The bigger the difference in earnings and the longer you were married, the larger the alimony payment will be.

Nevertheless, the die was cast in my ex’s mind so I had to take steps to protect myself, my biological son, and, to a degree, my step-daughter and former spouse as the divorce process moved along.At this point I decided to do some investigating and I found that the law firm of Cordell l Cordell (C l C) specialized in representing only men in divorces. After speaking and corresponding with a few attorneys and staff members at sundry different law firms in Knoxville, TN I finally decided to contact C l C and see what advice and services they could provide me with as I slogged through my divorce proceedings.I had an initial consultation with attorney John Vaught in C l C’s Knoxville office. A week or so later, I officially retained C l C to provide me with legal representation during my divorce. At that point, attorney Emily B. Vowell was assigned my case. Despite the fact that my case was not one with a great deal of financial assets to be fought over and, thankfully, had a relatively low chance of going to trial I found Emily to be a tireless advocate for me and my son. Emily and the staff at C l C kept me up-to-date on the status of my case and provided me with excellent advice as to how and when to provide documents for both my ex-wife’s counsel and C l C. More than once Emily demonstrated that she was willing to fight for my best interest even when I was, at times, willing to concede more than I probably should have been willing to give up.Ultimately, Emily stood by me and helped me make it through responding to my ex-wife’s divorce petition and child custody plan, discovery, and expertly guided me through the process of divorce mediation. I have used them for my second divorce and re-modification to that parenting plan. Both times I was very pleased with the services that were provided. My lawyer was always up front with everything. She kept me informed when necessary but didn’t go over board with emails just to claim the hours. I’ve had a lawyer in the past like that.
