Child Custody
Child custody refers to the rights and obligations between parents, regarding their children, after a divorce, legal separation, or paternity decree. There are two independent types of custody. Physical custody refers to the amount of time each parent is permitted physically with a child. This may be sole, primary, or joint custody. Legal custody refers to a parent’s decision-making rights regarding a child’s health, education, and welfare. It, too, may be sole, primary, or joint custody.
Child Support
Regardless of your fight to gain custody of your children, child support will be an issue in your case. You will either be paying it or receiving it. Courts have little discretion in setting the amount of child support to be paid. This is because, as a condition of receiving federal aid, the states are required to follow certain standards in their child support statutes. Although the exact procedures and details vary from state to state, there is a certain basic pattern no matter where you live.
Contempt Proceedings
Contempt can only come into play after a court has issued judgments, orders or decrees to govern the behavior of the parents, which it can do at any point during the divorce proceedings. Once a court has issued such decrees, it is important for you to observe them to the best of your ability and, at the same time, to take note of any potential violations on the part of your ex-wife or former partner. Courts have been known to take it personally when a parent disregards their orders.
Divorce Information – Petitions, Discovery, Settlement and Trial
Cordell & Cordell divorce attorneys work to ensure every client has the divorce information and family law resources they need to understand the divorce process and know what to expect before meeting with a family law attorney. A divorce can be a long process, and preparation is key in minimizing the length of your case.
Establishing Paternity in a Divorce or Child Support Case
When the parents of a child are not married at the beginning of the pregnancy or at the birth of the child, the father is legally without the rights and responsibilities of a parent. The father, mother, or a third party on behalf of the child, must seek a declaration of paternity to legally establish a parent-child relationship with the father. This process gives the father specific custodial rights while imposing upon him a legal obligation to provide specific financial support for the child.
Legal Separation
(In states where permitted.) Legal Separation is a court process designed to define the important rights and obligations between spouses when they live apart, but do not want divorce. The decree for legal separation establishes rules between the spouses regarding such issues as child custody, visitation, and spousal maintenance (alimony). It also divides property and usually debt. However, unlike divorce, the marital bonds are not severed and the spouses continue to be husband and wife. If, at any time during the legal separation, or thereafter, either spouse believes that the differences between them are irreconcilable, he or she may file a motion to convert to a dissolution of the marriage.
Military Family Law
When a couple decides to end their marriage while one spouse is serving in the military, divorce tends to get more complicated. There are specific rules about where to file for divorce, how to calculate child support, how to determine child custody, how to divide retirement benefits, and more that you need to know. At Cordell & Cordell, we understand the unique challenges military families face during divorce. Our attorneys are able to handle these cases to ensure that your rights and the rights of your children are protected.
Modification of Divorce Decrees
It’s not unusual for ex-spouses to want to change a prior decree respecting issues of custody and support. A party seeking to modify his decree must show a substantial and continuing change of circumstances. Those circumstances may include dramatic changes in income, relocation to another state, or problems relating to the proper care of his minor children. Cordell & Cordell will ensure that, to the extent possible, our clients’ goals are achieved in light of the new circumstances while preserving those rights provided for in prior decrees.
Power of Attorney
Sending your child off to college is an exciting experience, but it also brings a lot of stress. As a divorced parent, you have enough to worry about without being concerned about having access to your son or daughter’s educational, medical, financial, and other critical information.
Property Division and Asset Division
Every marriage has at least one topic in common – property. Whether they own a million-dollar mansion or a beat-up RV, a couple will always have to divide up the property and debt. Certain assets remain the exclusive property of one of the marriage partners, even after marriage, and some will be divided. This is done with debts as well. Most debt incurred while married will be shared upon dissolution, though a few personal debts may remain exclusively yours.
Protection Order
Protection orders are unfortunately common in family law cases and are often used for strategic reasons. The misuse of a protection order when going through a divorce is one of the more prevalent and unfortunate trends in family law. A system that was designed to protect against abuse is itself being abused.
Spousal Support, Alimony, Maintenance
In some instances a wife will ask for alimony, the court-ordered payment of money to your wife after the dissolution of marriage. If you made more money (especially if you were the primary breadwinner), there is a good chance your wife will seek alimony. The bigger the difference in earnings and the longer you were married, the larger the alimony payment will be.

Never did I think I would be using a divorce attorney. But life happened and I needed one. The process of divorcing is complicated, emotionally draining and compounds anxiety to a level that overwhelms you. One person that helped calm me was my attorney, Kamryn Caldwell. The ease of speaking with her about the process, financials, what to expect, how long it will take, etc. made things a lot better. Kamryn Caldwell was professional, straightforward, honest and thoroughly explained any question or concern I had. The more I knew the better I felt.

Divorce is always complicated, but mine was particularly complicated, and we wanted to make things were consistent for our daughter. Kamryn helped us create an amicable outcome that allows me and my ex-wife to co-parent in the best way for our child and also remain friends. She also did this without sacrificing any advocacy on my behalf. I would recommend her to anyone.”

Cordell and Cordell did a great job of navigating me thru my divorce. Kamryn Caldwell was always available to/for me and did a good job of keeping me informed/advised on all matters. Kamryn was very attentive to my concerns every step of the way, and even suggested/encouraged marriage counseling in lieu of divorce, if appropriate . Ultimately divorce prevailed but I greatly thank Cordell & Cordell, specifically Kamryn, for counseling me thru uncharted waters!

Positive: Professionalism, Qualityaste):My ex came after me for child support (including retroactive child support) for prior years after my son was already a teenager. We are still in the process of finalizing this nightmare, but Kamryn Caldwell was my saving grace and has diligently worked to pursue settlement agreements and ensure that the Attorney General’s figures for retroactive child support were correct (and of course, they weren’t).After Ms. Caldwell met with the Attorney General informally, he was on board with Ms. Caldwell’s numbers (she used to be a financial analyst by the way, which doesn’t hurt…just saying). She is literally saving me thousands of dollars in retroactive child support.I appreciate Ms. Caldwell’s attention to detail and excellent representation of my interests. Without her, I would be stuck with an order forcing me to pay thousands of dollars more than what the true calculations are.I would recommend Kamryn Caldwell (and Cordell & Cordell) to anyone dealing with child support and other family law matters. Thank you, Kamrynaste):My ex came after me for child support (including retroactive child support) for …More

I was a recently transitioned veteran and a student when I started my divorce with a different law firm, after a very bad temporary orders hearing I switched over to Cordell & Cordell. Here Kamryn Caldwell picked up my case, the difference was night and day, immediately. Divorce isn’t an easy thing to endure for anyone. But I contribute a huge portion of how my life is currently, feeling hopeful, is due having Ms. Caldwell and this firm with me throughout the duration of this incredibly stressful time. She told me more times than I can count “It’s a marathon not a sprint.” We paced ourselves and got what we wanted in the end.
