Every year people come to the United States seeking protection because they have suffered persecution or fear of persecution in their home country due to: Race, Religion, Nationality, Membership in a particular social group. Political opinion. If you are eligible for asylum you may be permitted to remain in the United States. There is no government fee to apply for asylum. To include your child on your application, the child must be under 21 and unmarried.

If your marriage is less than two years old on the day you were given a permanent residence, your residence status is conditional. On the day you are lawfully admitted to the United States after adjustment of your status or on an immigrant visa, you are given conditional resident status. Your status is conditional because it must be proven that you did not get married to evade United States immigration laws. In order to remove the conditions, you have to file Form I-751, Petition to Remove Conditions on Residence.

Each year, this program grants 65,000 special class, temporary visas to high-skilled foreign workers with at least a bachelor’s degree who qualify to work in the U.S. for three to six years. For noncitizens with advanced degrees from U.S. universities, another 20,000 visas are awarded. In order to hire individuals through this program, a company with operations in the United States must file petitions and confirm foreign workers will work in conditions similar to other employees and will be paid the prevailing wage rate for their positions.
I-601A Provisional Waivers
Beginning March 4, 2013, the provisional unlawful presence waiver process was updated to allow certain visa applicants who are parents, spouses, and children, or U.S. citizens to apply for provisional unlawful presence waivers before they leave the United States. It was developed to shorten the time span in which U.S. citizens and lawful permanent residents are separated from their loved ones while those relatives are completing the process to obtain their immigrant visas.

This is used to verify the identity and employment authorization of individuals hired for employment in the U.S. All employers within our country must ensure the proper completion of this form for each individual, including both citizens and noncitizens, they hire for employment within the United States. K-1 Fiancé or Fiancée Visa
This type of nonimmigrant visa is issued to the foreign-citizen fiancé or fiancée of a United States citizen so they may travel to the country to marry their partner (referred to as the U.S. citizen sponsor) within 90 days of arrival. After the couple marries, the foreign citizen applies to adjust their status to become a lawful permanent resident of the United States — a Green Card holder.A K-1 visa allows the holder to immigrate to the United States and marry a citizen shortly after arriving, so the fiancé or fiancée must meet some of the requirements of an immigrant visa. Children of eligible K-1 visa applicants receive K-2 visa designations, as they derive their immigration status through their parent.
L-1A Visa – Intracompany Transferee Executive or Manager
This classification enables U.S. employers to transfer a manager or executive from one of its foreign offices to an office in the United States. It also enables foreign companies without affiliated U.S. offices to send a manager or executive to the United States with the purpose of establishing one.
LCA / Public Access File Compliance
The United States Department of Labor has certain regulations regarding the sponsorship and employment of an H-1B worker. This includes providing sufficient proof that working conditions and success of similarly employed workers will not be affected. The Labor Condition Application (LCA) is completed by employers before they file any petitions for H-1B approval. In addition, the USDOL requires employers to post the LCA in two conspicuous places in the location of employment for 10 consecutive working days.An employer can also post a notice containing certain information from the LCA, including the occupational classification of workers being sought, the number of H-1B workers being sought, the wages to be paid, the period of employment, the locations in which the workers will be employed, and information on where complaints of misrepresentation and/or noncompliance can be made.

This temporary worker visa classification is granted for individuals who possess outstanding abilities within the sciences, arts, education, business, or athletics, or those who have a demonstrated record within the motion picture or television industry — and has been recognized on a national or international level for their achievements.In addition to the O-1 visa classification, there are subsequent designations for integral individuals to assist in the main applicant’s activity or production, as well as for dependents of the main applicant.
