Bankruptcy has many advantages for people who are facing extensive amounts of stress from attempts at debt collection. For most individuals, the main goal of bankruptcy is to discharge debt to end creditor harassment and become financially sound. Discharge means that your debts are forgiven and eliminated, but you might be required to recognize the income for tax purposes.

Exempt Property
Your nonexempt assets can be liquidated to pay back your creditors, but many individuals are able to keep all of their personal property. Under federal and state bankruptcy laws, people who file are able to exempt certain property from liquidation. Under Indiana law, there are three main exemptions: homestead exemption, personal property exemption and general intangible exemption.

Garnishments
Garnishment is one of many actions creditors use to collect from debtors. Indiana state laws limit the amount that creditors can take from debtor’s paychecks, which is up to 25% for most net wages. Wage garnishments are orders from the court agency and are sent to the debtor’s employer. Creditors will receive a set amount from the debtor’s paycheck that their employer is forced to withhold. Wage garnishment can make it so that you are not able to fully support yourself and your family.

Sheriff’s Sales
Foreclosure on a home is not an action that takes place immediately. It may even take many months before a foreclosure is completed. The final step in the foreclosure process is the sheriff’s sale, an auction that follows a court order to seize property. Once your home is sold in a sheriff’s sale, you lose all rights to it. If you are facing a sheriff’s sale and want to protect your home, you must act quickly.

Mr. Jackson and his staff were so friendly, courteous and they made this experience better than we could have expected. We felt defeated with our finances but after 5 years, we are back on top and enjoying life again. Stacey is so helpful and always quick to respond on any questions we had. Thank you!!

The first time I walked into the office I like how Stacey was very pleasant with me. I love this law firm; they are the best. I have had two separate cases they helped me with. They are so patient, and there is no pressure to when you are ready to file, they are willing to consult with you for free. Michael is my lawyer and Stacey his assistant was awesome. I had the chance to meet with John the other lawyer that also work with Michael; they are delightful. They all listened to me in my lowest situation and never judge me because they understand that everyone does go through a rough part in life and it’s not permanent. Their prices are reasonable, and they work with you as well. Great people and great minds along with a wonderful professional friendship.

Dana was amazing. We had a unique situation and she was able to handle it quickly, professionally, and with empathy. When we met with the judge, it was clear that she was highly respected- she was quite possibly the only counsel that did not get reprimanded, or have further requests made of them. I was so impressed and would recommend her and Jackson & Oglesby in general, to anyone seeking these type of legal services. You will not be disappointed by the level of professionalism and care you receive.
