Our firm will advise its clients as to what matters can be negotiated and to what extent their creditors may accept certain offers.
Bankruptcy Adversary Proceedings
Bankruptcy Reorganization
Chapter 11 Bankruptcy Attorney
A Chapter 11 reorganization case allows a business or an individual with significant debts and assets to protect itself from its creditors while it concentrates on reorganizing its affairs. The initial filing of the Chapter 11 case immediately protects the business from its creditors. Afterwards the business goes through a period of supervised court administration during which it takes steps to improve its finances, shed unnecessary expenses, and negotiate with important creditors while continuing its protected status. Towards the end of the case, a Chapter 11 bankruptcy case requires the debtor to offer a plan of reorganization, which cures, extends, and in some instances, reduces many of the debtor’s obligations.
Chapter 13 Bankruptcy Attorney
Chapter 13 is a very effective type of bankruptcy case and is used by individuals in various situations to reorganize and reduce debt. A Chapter 13 bankruptcy case is often used by persons in foreclosure to stop the foreclosure process, including foreclosure sales, so as to cure mortgage arrears over a five (5) year Chapter 13 plan. Chapter 13 is also used by individuals who do not qualify for Chapter 7 relief because they have incomes that exceed the means test based on their household size. A Chapter 13 reorganization is an involved and potentially lengthy bankruptcy case and requires special knowledge and expertise. The Law Office of Ronald D. Weiss, P.C. regularly represents its Long Island and New York clients in Chapter 13 cases before the United States Bankruptcy Court and can review with you issues relevant to a potential Chapter 13 case.
Chapter 7 Bankruptcy Attorney
A Chapter 7 bankruptcy case will eliminate most or all of a client’s debt, and will allow the client to obtain a fresh financial start. A Chapter 7 case is a highly effective tool in dealing with burdensome credit card and other unsecured debts, such as medical bills and personal loans. A Chapter 7 case is especially helpful when the client cannot pay their present bills and faces the prospect of creditor harassment, collection actions and bad credit. The Law Office of Ronald D. Weiss, P.C. regularly represents its Long Island and New York clients in Chapter 7 cases before the United States Bankruptcy Court and can review with you issues relevant to a potential Chapter 7 case.
Foreclosure Attorney
As you must be aware there is presently a foreclosure crisis in the United States, which has seriously affected our Long Island and New York areas, due to many factors: sub-prime loans, overly aggressive lending and borrowing, a rapidly rising and rapidly falling real estate market and many other global forces that are decreasing our ability to earn the same real incomes as in the past. In this turmoil many homeowners to their dismay have found themselves in arrears on their mortgages and in foreclosure or threatened by foreclosure. Because homeowners are frequently confused as to their options, and because the advice of their mortgage holders can be inaccurate and/or misleading, a homeowner threatened by foreclosure or in foreclosure needs to quickly get reliable information from an attorney who concentrates in this area.
