Critical: Professionalism06-21-21This is a classic case of ‘PEOPLE THAT NEED TO BE STOPPED’! These two attorneys Arnold Bruckner –retired, and Michael Wein] took a Massachusetts case on [02-15-07] to litigate in Maryland at the request of my mother [& me-Peter Garrity]. They charged $71,000 to tell us after 5 months that they couldn’t litigate the case & that we needed to return to Massachusetts to continue. $33,000 IN UPFRONT CASH, $38,000 ON A JUDGMENT OBTAINED AFTER THE FACT!!They never told us that under US CODE Statute 28, that a civil case originating in another state, FIRST has be filed in that STATES’s Federal Court BEFORE it can be removed to another state’s Federal Court. AND ONLY THE DEFENDANTS CAN DO THIS—WE WERE THE PLAINTIFFS!! This is called …”REMOVAL OF JURISDICTION”.When we got to the hearing in the US District Court of Greenbelt, MD., the Federal Judge said…”What are you people doing here?? This court as NO JURISDICTION HERE!! GO BACK TO MASSACHUSETTS!’. Wein and Bruckner knew this and just bilked us out of $71,000.00!The MA attorney whom we approached took $5K and said we had no case…Res Judicata, Collateral Estoppel & Statute of Limitations. He was a bargain @ $5K!In the judgment case, 9-26-2011, [ I had to go pro se as other attorneys wouldn’t take the case nor did I have funds to retain counsel]. I was not allowed to bring in the US Code Statute #28, the Massachusetts Attorney’s opinion or the Transcript from the Federal hearing. A totally corrupt legal outcome as the biased Judge was going to punish me for being pro se. Bruckner did not participate in this case as Plaintiff, but Wein did and now he wants to garnish a 90 year old grandmother, 10 years after the judgment was entered whose only income is a $1,365.00 monthly Social Security check. At the time of this case judgment, I did not even have the $150 to ‘appeal’ the corrupt outcome.Wein and Bruckner merely AMENDED our original pro se filing in Federal Court where we had no business filing in Maryland for a civil case originating in Massachusetts. But the filing had no business being there. We didn’t know. We’re not attorneys.Suffice to say, this had catapulted my mother into destitution of an existence out of a hotel room since 2009 and now 6 years of subsidized section 8 housing.Attached is the joke retainer agreement which started out at $10,000 and ballooned to $38,000.00. If stealing that amount wasn’t enough, Wein took it upon himself to ascertain a corrupt judgment whereby the simple facts of law concerning removal of jurisdiction couldn’t be brought in as evidence. Therefore we had no case.Now on top of the $33,000 we paid to Bruckner and Wein, Wein went forward and obtained a $38,000.00 judgment that needs to be vacated. Phenomenal Woman
Received a phone call from this attorney for a consultation. He was rude, condescending, demeaning, and arrogant. He had absolutely no clue what he was talking about and was clearly not knowledgeable in the area he was advising me on, yet had the audacity to criticize my claim when there is not only an extensive evidence base in peer reviewed journals but also a qualified expert would attest to what I told this attorney. He kept dismissing me and acting as if I don’t know what I’m talking about when I’m a highly educated, advanced practice health care professional who knows the accepted standard of care. It is clear Michael Wein is only concerned about making money rather than justice or doing what is right. If someone’s life is changed because of the negligence of another and has incurred significant personal injury that has interfered with the ability to finish school and pursue gainful employment, that party should be held accountable. Too bad Michael Wein prefers to make excuses about the merits of a case even when there is documented precedent, rather than admit he cannot take it on because it is too much of a challenge to him personally and he lacks knowledge and expertise about the specified field of medical practice or the four elements of negligence. Needless to say, it is important for people like me who have been harmed by professional negligence to know our rights and to insist on being treated respectfully and with dignity. We do not have to sit back and assume there is nothing we can do about the injustices we have suffered at the hands of professionals who seem so much more powerful than we may feel. He told me to “move on.” Completely unprofessional. I look forward to seeking justice with the help of those who actually know what they are doing.
