Unfortunately, family violence is often a part of the divorce process. If you’ve found yourself in danger of physical attack or emotional abuse from your spouse, don’t wait for something else to happen. There are family violence protections that you can take advantage of to keep the danger at arm’s length. For example, emergency orders are extraordinary relief a court can order to preserve and protect people, property, and assets from potential harm or harassment.

Adoption Attorney
The right family lawyer can make the adoption process much easier. The Law Office of Rachel Li has the experience you are looking for. As a family law attorney, Rachel Li brings personal experience to families considering adoption, because she is an adoptee herself. Being able to adopt is a joyous occasion for all family members–both parents and children, whether beginning a new or extending their existing family. When people come to The Law Office of Rachel Li to discuss their family needs, we often have an immediate bond. If you are considering the process for your family, it makes sense to consult with someone who understands the legal process, as well as the emotional process.

Alternative Dispute Resolution
Alternatives To Divorce Litigation
Mediation is a sub-category of alternative dispute resolution. Over my many years of practice, I’ve determined each divorce case is unique. And the facts and parties involved will dictate which approach to the case works best. However, I always evaluate whether it is a viable alternative. Not only do I recommend the process, but I facilitate mediated settlements. As an alternative dispute resolution method, mediation is used to avoid litigation and resolve the dispute between the parties. Mediation uses an independent third party, a mediator, to facilitate communication between the disputants. The goal of mediation is to help the parties reach a settlement agreement. Mediation is also private and confidential, and it follows a structured timetable with dynamics that ordinary negotiation methods lack.

Business and Divorce
Dividing a business in divorce can be complicated. It requires knowledge of capital investments, tax laws, growth potential and the subjective value of customer goodwill toward the owner. Given my background in accounting, I have experience evaluating complex property arrangements and balance sheets and in determining the valuation. When necessary, I work with independent professionals to provide a full analysis of business assets and investment holdings subject to equitable distribution as marital property.
Child Custody
We all try to do our best to protect our children from harm. In Texas divorce courts, judges and child welfare professionals put the child’s interests first. This could mean putting a child between two loving parents who believe they both know what’s best for their family. The Law Office of Rachel Li can help, schedule a consultation today.
Child Custody Modifications
Child Custody Modifications are fairly common. Over time, people’s lives change. If your custody case, access (visitation) schedule or child support no longer work, you have the right to petition the court to modify your agreement.
Child Support
The Texas family code defines the rights and duties of a parent to support their child. As a result, there is great interest within the legislature and the judiciary. In fact, the mission statement of the Texas office of the Attorney General – Child Support Division is “…to make sure every child receives the support they need and deserve.”

Divorce Attorney
No one enters a marriage planning to get a Divorce Lawyer. The decision to dissolve a marriage is never easy, and usually painful and disorienting. Divorce involves strong feelings and conflicting emotions that may interfere with your ability to think and plan clearly and effectively. If there are children involved, things get even more complicated.

Family Violence and Protective Orders
Protective orders are issued for family violence, whether against a spouse, children or extended family members. When threats are made against a family member, the court can issue a protective order to help insure the family’s safety and standard of living.

Grandparents’ Rights
Grandparents are often an important part of a child’s life. They provide unconditional love, kindness, patience, and comfort. Grandparents play an essential role in their grandchildren. If your adult child is divorcing that doesn’t mean you have to lose the connection you have with your grandchildren.
High-Asset Community Property
Texas has different laws regarding the division of individual and marital property in a divorce. Even when one spouse has protected investments, business holdings, or other personal estate assets through a prenuptial agreement, courts may rule that earnings on those investments are classified as marital property.
Injunctions
An injunction is generally a more permanent form of court intervention. An injunction is a court order that requires an individual to perform or refrain from performing a specific act. Injunctions may be one of the following types: preliminary, preventative, mandatory, or permanent.

Marital Property Protection
For more than a decade, I’ve successfully negotiated many property division settlements out of court. But for those times when alternative methods cannot settle the dispute, I’m prepared for trial. When an out of court settlement cannot be reached, I’ll employ an aggressive litigation strategy and take your matter to court. In addition, I have a network of independent professionals to assist in the following areas:Forensic accountants to uncover hidden investments and assets,Actuarial accountants to determine the future value of investments,Intellectual property attorneys to value patents, intellectual property, copyrights and trade secrets,Realtors for residential and commercial real estate as well as investment property valuations,Financial planners for pensions, individual retirement accounts, 401(k) and 403(b) accounts,Auditors for business and professional practice valuations.
Out Of Court Settlement
Parenting Plan
Paternity Actions
In Texas, the courts generally believe parents have a right to be involved in their children’s life. Similarly, a child has the right to develop a relationship with both parents. However, in certain circumstances, the court may decide to protect the child’s interest in a paternity case by not allowing parent access.

Postnuptial Agreements

Prenuptial Agreements
Marital agreements covering personal financial assets can be a good idea for anyone getting married in Texas. They are especially important for anyone planning to get remarried.Without appropriate protections in place, all property owned by either party may be subject to classification as marital property. In the event of divorce or the death of a loved one. your ex-spouse and stepchildren may have an equal claim to assets and property that may have been part of your family legacy for generations.

Property Division
Property division (or equitable distribution) is the judicial separation of marital assets and obligations during a divorce. The division of property may be done by agreement, through a negotiated property settlement, or a judge can order the distribution through decree. The Law Office of Rachel Li specializes in property division. Schedule a consultation today.

Temporary Restraining Order (TRO)
A temporary restraining order is issued by the court after the moving party applies for relief from threatened harm to the party’s or the parties’ property. The court may grant a TRO to direct a party to refrain from certain activity after applying the following tests. Will the moving party suffer irreparable injury? Will the moving party succeed on the merits? Will the opposing party be harmed more than the moving party is helped? Will granting relief be in the public interest?
Termination Of Parental Rights
Termination of Rights
Not all parents have the capacity, resources or desire to handle parental responsibilities. In some cases, it may be in the child’s best interests to formally terminate parental rights in order for another person to obtain full physical and legal custody over the child’s welfare.
Trusted Family Violence Advisor
Family violence, also known as domestic violence, is far too common in society today. Any threat of violence against you or another member of your household is considered to be family violence. If you or a member of your family are the victims of family violence, your best interest is to take appropriate actions immediately. Protect yourself, as well as the other members of your family, especially your children.
Wills And Probates
Writ of Reentry
A writ of reentry is a court order issued by the justice court with jurisdiction over the premises in question because of an alleged illegal lockout. The tenant must enter a sworn complaint and appear before the court to present oral testimony under oath regarding the facts of their complaint. After hearing testimony and reviewing the facts of the case, the court will make their ruling and issue any necessary order.

Critical: Professionalism, ValueI was looking forward to having an amicus attorney appointed to help represent my children in a case where they were deeply wounded. I had a terrible situation where an ex had really messed up and the kids needed the representation. Before I comment on her though, know that our divorce settled wonderfully and the kids received what was in their best interest in the end, but it was despite the work of Rachel not because of her. She did her work without focus to keys issues and clearly showed an incompetent bias. My impression is that she was quite pretentious and lacked any real skill or knowledge according to the areas that directly affected our children. Her court room appearances were out of step with the tone and direction of the case. Her billing was unclear and money was spent haphazardly and out of proportion to the scope of the issues. I can’t caution you enough, if you are concerned that your money be spent reasonably, clearly and wisely, not to hire Rachel. Aside from my lawyer who was brilliant and fantastic, I would quite literally prefer my ex’s lawyer over Rachel for Family Law matters. My kids were lucky to be protected from her. Yours might not be. Run fast. This is not the lawyer for you.I was looking forward to having an amicus attorney appointed to help represent my children in a case where they were deeply wounded. Rachel is fighter and winner. She was hired during the middle of my case to represent me and my rights against a corrupt spouse.
