Division of the Marital Home
Many times in a Colorado divorce, the largest asset, and the largest debt, a couple has are the same thing – the marital home. Typically, the parties have some equity in their home and the largest share of marital debt is represented by their mortgage. In a divorce, the court must divide all the assets, including the marital home.

Domestic Violence
It’s completely normal to feel uncomfortable discussing domestic violence or spousal abuse. However, it’s also important to protect yourself and know your rights. You have the right to live out your life without fear of assault or injury. Domestic violence is a serious violation of someone’s civil liberties, and in recent years, the U.S. Department of Justice has amended the exact definition of domestic violence to greater defend victims of abuse and bring the perpetrators to justice.

Father’s Rights
Any man that is trying to establish his fathers rights or is the alleged / presumed father of a child is referred to by the state as a “putative” father. The rights of unmarried fathers are clouded in uncertainty. Only 20 states legally establish paternity after a state-approved paternity test. With Colorado on the list, it’s important that males seeking a fathers’ rights attorney pursue effective legal counsel as they seek paternity testing or fight for paternity they feel is deserved despite a lack of biological ties.

Modification of Orders
Mother’s Rights
Mothers’ rights in divorce, and other family law cases, face the competing interests of the needs of the children and involvement of the father. The court must evaluate the needs of children involved and what may be in their best interests. Knowing that a judge will be weighing this can help mothers successfully focus their cases and obtain positive results for themselves and their families.
No-Fault Divorce
No-fault divorce is a foreign concept to many people going through the process. During a divorce, spouses may want to lay blame, or hold the other spouse accountable, for some perceived fault. Perhaps one spouse cheated, or broke promises that caused the divorce, and as a result, the other spouse is being forced to completely change their life, their lifestyles, and incur tremendous expense. The responsible spouse should pay! However, the concept of no-fault means that a Colorado divorce court will not look into the reasons why the divorce is occurring, or why the marriage is failing. A divorce court will not change how it allocates property, or divides up parenting time and decision-making based on who is at fault.
Parent Timesharing
Parental Alienation Issues
Several jurisdictions recognize parental alienation by another parent as an actual and diagnosable issue. In these jurisdictions, it is weighed heavily because the court recognizes the susceptibility of children to the influences of a parent.

Paternity
Paternity Relocation
Property Division
While it might seem easy to identify what assets a couple has that are subject to a division via divorce court, there’s nothing easy about it. Sometimes, property that you bring into a marriage is separate, but it can become marital. For example, if you own a house before the marriage but you pay the mortgage together, is this a joint asset?
Protective Orders
Retirements Plans
Same-Sex Marriages
Separation Agreement
If the parties in a dissolution of marriage are able to settle their divorce in Colorado, they prepare a separation agreement. This lays out the agreed-upon terms. Specifically stating the terms can be very helpful to the Colorado family law court in determining whether or not the terms are fair to the divorcing parties involved.
Spousal Maintenance
Spousal maintenance, also known as alimony, is the payment from one spouse to the other. It is the recognition by the law that marriage is a joint endeavor and both parties should share in the fruits of that union. It is also one of the most difficult aspects of any divorce. Unlike child support, there’s no formula we can apply. One judge could say $100 a month while another, with the same set of facts, may say $1,000 per month. Negotiating maintenance obligations presents special difficulties, and it’s encouraged that you protect your interests by working with an attorney who specializes in family law and especially spousal maintenance issues.

I was referred to Craig Valentine by the friend of a friend to discuss a post-divorce motion that I wanted to file regarding the welfare of my children. After speaking with him, I knew he would do a great job for my family. He and his wonderful paralegal, Patty Wallace, are extremely knowledgeable, thorough, and most importantly, THEY ARE ON TOP OF EVERYTHING. I rarely had to contact Craig to find out the status of my case. He was often contacting me if he hadn’t heard any updates from me, needed paperwork, or wanted to discuss options on how we could proceed with my case. He was always very informative, laying out all of my choices and the possible positives and negatives of each, never pushing me one way or another. Of course, if I asked his opinion on what he thought I should do, he’d happily provide his guidance without making the decision for me. Additionally, Patty was always so quick to respond to my emails and was so empathetic. She truly has a gift of making her clients feel almost like friends. Many paralegals don’t take the time to text you the morning of your court date to wish you luck, but she did! I really appreciated that. Overall, I would not hesitate to employ Craig & Patty, should any additional, unfortunate family disputes arise in the future. Thank you, team!

I am really happy with my legal team at Modern Family Law. Jackie and Laura were fantastic. I hired Jackie Collins just 2 weeks away from my court date, but she took on my case and immediately got to work. Right from our first conversation I could tell she really cared about my case and my son. She was kind, compassionate, professional and I really felt heard. Though we didn’t get the exact result we wanted she did better my situation and honestly it’s all I could have asked for because I gave her a really difficult case. She was ridiculously thorough, prepared and was just amazing in court! I’m so thankful I had her in my corner. Thank you Jackie. Thank you so much.

We had a great experience working with Chelsea and Patricia during a very stressful time trying to get emergency and then permanent guardianship for an unrelated minor. Chelsea took the time to educate me during my first call whereas other offices refused to give me any helpful information without a retainer. That is why I went with her. They made it super easy to communicate and always responded promptly. We hope to not need them again, but I would use them again and would recommend them to anyone with custody or guardianship issues.

Jackie Collins!!! What an angel. We had the best experience with her on our side. I could not have ask for a better Attorney and Paralegal Laura. Jackie and I seemed to have a bond with our first conversation. You are blessed in so many ways if you get Jackie on your side. Jackie is truly caring, compassionate and genuine. She has a special way of boosting your spirit when it is low or you are stressed. She works non stop for all her clients. Jackie and Laura will go above and beyond for you and your case. They listen and get results. We love you Jackie. Thank you Craig for referring me to the BEST. She was and is the perfect fit.

I highly recommend Modern Family Law to anyone needing legal representation for civil cases. Craig and Patricia were extremely professional and very responsive to my questions. They always kept me informed on any updates involving my cases. Knowing that I was being represented by Craig, I felt confident about achieving a positive outcome on what I had felt were daunting legal challenges. Fortunately I was able to have my case settled before needing to battle it out in court.

I worked with Jackie for about a year (even followed her from another firm). She made me feel comfortable, respected, and listened to me. Divorce is obviously an hellish ordeal. I could tell she truly wanted what was best for me and was trying to make the process easier on me. The difference between her and my ex’s attorney was obvious– his attorney was out for the attorney fees, whereas Jackie was doing what was best for me. If you’re contemplating a divorce, this is my one piece of advice– find an attorney like Jackie who will do what is best for you (knows the law and isn’t trying to manufacture conflict for his/her own benefit). I ultimately made a choice that was best for me– and she was supportive and respectful. This really doesn’t give her justice– but she’s a great person and you can trust her completely with your case.

Craig Valentine and Patricia Wallace handled my case with me and my concerns centered. They provided necessary guidance and made everything as easy and quick as possible, utilizing zoom, email, e sign, etc to work with my schedule and familial obligations. Family issues and court are hard enough as is, it’s nice to have people in your corner that are friendly, knowledgeable, and consistently on your side. I highly recommend this duo!

I was referred to Craig Valentine by my previous family lawyer. Craig and his paralegal Patty Wallace were amazing. My situation was very emotional, as I am sure most family law issues are. They gave we swift filing, sound advice and even a friendly word when needed. If I ever need a family legal team again I will most definitely return! Thank you Craig and Patty!
