Processing times vary depending on preference categories, and can range from 35-50 months.

Immediate Relatives of U.S. Citizens
The first category with the highest priority is for Immediate Relatives of U.S. Citizens, including spouses, parents, and unmarried children under 21 years of age. In some cases these visas may be processed in as little as 6-12 months. Immediate Relatives of LPRs may have their applications processed in as little as 11-18 months.

Intra-company Transfer Temporary Visas
Foreigners who own or work in an executive/special knowledge capacity for a foreign company with operations in the United States may qualify for an L-1 visa.
Investment-based Permanent Immigrant Visas
This is the employment-creation visa, which allows foreigners to gain conditional permanent residence status in the United States to enhance employment opportunities for American workers. Investment minimums vary from $500,000 USD to $1,000,000 USD, depending on the area in which the investment will be made. A condition is placed on the foreign investor for two years, after which the investor may petition for the condition to be removed and to be granted Lawful Permanent Residence.
Investment-based Temporary “Treaty” Visas
Foreigners from certain nations that have trade treaties with the United States may qualify for an E-1 visa to enter into the United States to conduct substantial trade that is principally between the U.S. and the treaty country. Individuals from certain treaty nations may also qualify for an E-2 visa to enter into the U.S. to develop and direct the operations of a U.S. business in which the foreigner is investing substantial capital.

K-1 Fiancee visas
K-1 visas are special visas granted for a limited period of time to allow fiancees of U.S. Citizens to enter the United States for the purposes of marrying the U.S. Citizen. In some cases these may be processed in as little as 5 months.
Permanent Immigrant Employment Visas
In other cases, U.S. businesses will petition for a foreign worker to be granted Lawful Permanent Residence based on the employment relationship. These petitions are typically for foreign workers with extraordinary abilities, professionals, executives, and advanced degree holders. In some cases, a Labor Certification is necessary to demonstrate that the employer is not displacing U.S. workers. In some cases, an employer may file to change the status of a temporary non-immigrant worker to Lawful Permanent Resident.

Temporary Non-Immigrant Employment Visas
In some cases, U.S. businesses wish to employ foreign workers that have special skills or fulfill a certain niche on a temporary or limited-duration basis. In these cases, the U.S. business will sponsor the foreign worker, and will file a petition on behalf of the foreign worker (the beneficiary). The most common is the H-1B employment-based nonimmigrant visa, but others include H-2A, H-2B, H-3. Temporary foreign workers from Canada and Mexico may qualify for a TN visa, which is based on the NAFTA Treaty.
