I was very displeased in my business dealings with Todd South. We worked as a site contractor on a residential development in Palm Harbor for Marc Rutenberg Homes. Todd South represented the lender on this project. Marc Rutenberg failed to pay our company $300K owed for the sitework construction that was completed in July of 2021. We patiently waited for payment until the point our lien rights were about expire. With no payment plan being discussed we liened the development and were forced to threaten litigation. After the lien we were offered a variety of payment plans that did not include directly paying the $300K we were owed. Todd also tacked on the threat of foreclosing on the property and essentially wiping out the $300K that Burgess Civil was owed. Basically trying to bully us (the contractor) into taking an option other than the $300K we were owed for our work on the property. I assume his client (the equity partner developer) was pleased with Todd’s tactics or may have directed Todd to use these tactics. On our end it felt like we were being boxed into a corner by someone with a larger wallet. The message from Todd was basically take what we are offering or you risk collecting $0. Eventually Todd’s bullying tactics of threating foreclosure all became idle threats. We were made whole for the $300K 6+ months later in January of 2022 and released our lien. However as a contractor that works extremely hard to provide a service the right way it left a bad taste in my mouth. I felt this information needed to be shared to help protect other contractors who may end up in a similar situation of no wrong doing of their own. It was uncomfortable being treated this way by an attorney on behalf of his client with a large bank roll. I believe Todd’s actions were done within the law but in some ways it felt unethical for our construction company to be treated this way. Todd may be a great attorney if he is acting on your behalf as a developer. However as a contractor, if approached by Todd, I would be very cynical of the information he may provide to you.
