Discrimination Law
California, through the Fair Employment and Housing Act, in 1959 took a stand against discrimination in the workplace. Since that fateful year, employers have been prohibited from discriminating against employees on the basis of race, gender, sex, national origin, etc. It was not until 1979, though, that the anti-discrimination protections expanded to include “sexual orientation” for state employee, and then to all employees in 1992 (kudos to the District of Columbia and Pennsylvania for enacting that protection for state employees in 1973 and 1975 respectively). Despite these protections, people’s biases, prejudices and hatred continue to unabashedly permeate the workplace. Employees should be judged on work performance, not on the color of their skin, the age on their birth certificate, or the gender with which they identify. If you or someone else is being subjected to unlawful conduct at work, you have a right to report that conduct to the company to see that it is corrected. California made workplace sexual harassment illegal in 1959, five years before the Federal Government followed suit in 1964. California continues to be a pacesetter in combatting sexual harassment, requiring more sexual harassment training for employees than the Federal Government. Sometimes sexual harassment is more subtle than grotesque sexual advances, but it is illegal and disruptive, nonetheless. Wage and Hour Law
Most businesses rely on the work of their employees for their success. Unfortunately, these same employers frequently disregard the value of their employees, and unfairly (and unlawfully) take advantage of their employees.
