Family Law Attorney
Adoption legal services
Adoption can change the life of a child forever. At Tolison & Williams, Attorneys at Law, LLC, we handle several types of adoption, including stepparent adoption, kinship adoption and custodial adoption.
Child support litigation
However, when litigation is necessary, we offer tenacious representation that will ultimately lead to the best possible outcome for you and your family.
Contested divorce litigation
I will make every effort to settle your divorce outside of court. However, if this is not possible, I am ready and able to advocate for you in litigation.

Custody & visitation rights litigation
However, when litigation is necessary, we offer tenacious representation that will ultimately lead to the best possible outcome for you and your family.
Divorce litigation
Mediation is generally considered to be less expensive than litigation. In mediation, you and your attorney will work with a certified mediator who can assist you and your spouse in coming to an agreement.
Father’s rights litigation
Guardianship litigation
Mediation
Mediating a divorce is a great way for couples to better facilitate what’s best for the dissolution of a marriage. Typically, you and your spouse (along with your lawyers) will meet with a mediator to help negotiate and potentially compromise on how a marriage will end.
Modification of court orders
No matter how drastic the change, you need a child support modification attorney who will look out for your best interests and dig into the details of your case.
Paternity establishment litigation
Paternity can be a complex area of law. In Colorado, DNA testing may be used to establish paternity. Under our state’s law, a man is presumed to be a child’s father when testing results in a 97 percent or higher probability of paternity.
Prenups & marital agreements writing
Most have this idea that prenups are only needed when one of the spouses is a high net worth individual. However, couples in Colorado sign prenuptial agreements for a variety of reasons, even when they don’t have any significant financial estate.
Probate legal services
Probate refers to the court process for distributing an individual’s assets following his or her death. However, it also encompasses other types of proceedings.
Property division litigation
In Colorado, property division is equitable, but equitable is not the same as equal. When dividing assets after a divorce, many subjective components come into play.
Restraining order litigation
Restraining orders are issued for people who fear for the lives and safety of themselves and their children. Restraining orders begin as temporary until a hearing is held, at which time they can become permanent.
Spousal support & alimony litigation
Spousal maintenance or alimony is not regulated by any base guidelines. Instead, the decision to award support is based on individual circumstances, and the amount and duration of support can vary.
Uncontested divorce legal services
In our experience, uncontested divorce in Colorado is usually the fastest and cheapest way to separate from your spouse. Our Colorado divorce attorneys are always focused on ensuring that our clients can complete their divorce without attending court hearings.
Administration of final affairs — probate and trust settlement
The settlement of a decedent’s final affairs, whether through the probate process and/or through a private trust settlement, can be a complicated process. I represent personal representatives, trustees, heirs and beneficiaries and work to guide my clients through these emotional and technical cases.

Children’s Law
Common Law Marriages
Within your common marriage, any item of value obtained after the couple mutually agreed they were a married couple will be treated as marital property.
Complex Divorce
Contested Divorce
In a contested divorce, one party files a petition with the court and the other party is expected to respond. This is common when spouses cannot agree on terms of the divorce (like child custody, property division, and other terms), and spouses will need to hire a divorce lawyer in Colorado.
Custodial Adoption
This type of adoption typically occurs when a nonfamily member has custody of a child. Often, custodial adoptions are sought by foster parents who have come to know and love the children they have welcomed into their homes.
Dissolution Of Marriage

We understand that families come first. We understand the stress, anxiety and fear that accompany the separation of a family. That’s why we do what we do.

Although they still have to deal with property division, custody, and support matters, these can be elevated to a much higher degree when more assets are involved. In these circumstances, it is in your best interests to hire an experienced family law attorney.
Divorce Family Law
Colorado is a no-fault divorce state. Neither you nor your spouse needs to take the blame for deciding to end your marriage. This means that marriages can be dissolved when one spouse believes they have “irreconcilable differences” or “irreparable breakdown of the marriage.”
Divorce Issues
Respectively, division of debt often becomes one of the central issues in their divorce. An experienced Colorado family law attorney can help ensure that your marital debt is distributed fairly and equitably.

Grandparent Visitation
Whether you are looking for the right to visit your grandchildren or trying to learn how to file an emergency motion to get child custody, remember: you can only file the motion to intervene if there is currently an open child custody case in court.
Gray Divorce
Divorce is a stressful event at any time of life, but it may be even more so among spouses over 50. Because, apart from the emotional factors, gray divorce also carries additional legal complexity when it comes to asset division.
Guardianship And Conservatorship
If you believe a loved one is unable to make decisions due to incapacity, you might consider seeking the legal authority to act on his or her behalf. However, both guardianship and conservatorship proceedings may be lengthy, complicated court cases. There are extensive requirements regarding notifying others of the proceeding, filing the proper paperwork and submitting evidence of your loved one’s incapacity. Even after the proceedings are concluded, the court will remain involved in your loved one’s life in a supervisory capacity, and it is important for a guardian and/or conservator to seek the ongoing support and advice of an attorney.
Guardianships and Conservatorships
When an individual is mentally incapacitated, a court proceeding may be required to appoint a guardian and/or conservator to manage that individual’s personal and/or financial affairs. At Tolison & Williams, LLC, I represent applying and appointed guardians and conservators to help them fulfill their fiduciary obligations and comply with other legal requirements.
High-Asset Divorce
When seeking a divorce, business owners, doctors, farm and landowners and other high-income/high-asset individuals face additional complexities. Although they still have to deal with property division custody and support matters, these can be elevated to a higher degree when more assets are involved
Irrevocable Trusts
A revocable living trust is a type of trust that can be modified or revoked at any time, while an irrevocable living trust is not able to be changed or canceled. There are more differences between the two than that, however, with advantages and disadvantages to each option
Joint Custody
Even when divorcing parents believe they can get along with one another, both parties should seek legal advice when it comes to child custody. Contact our family law attorneys today for further advice on joint custody issues.
Joint Ownership of Property
Most people think of property ownership as a singular, all-or-nothing concept. In fact, the law permits many forms of ownership, each with a unique set of rights. The form of property ownership affects its ultimate disposition. Thus, a critical part of estate planning is examining the ownership of your property and ensuring that it reflects your wishes.

Kinship Adoption
We represent grandparents, aunts, uncles and other relatives in kinship adoptions. Each of these adoptions is unique and occurs because of different circumstances. Often, relatives have cared for the child for many years before the adoption takes place, so the child is already integrated.

Living Wills
A living will, also called an advance health care directive or advance medical directive, establishes your wishes regarding medical treatment and life-sustaining procedures. It is a critical estate planning tool that empowers you to make important end-of-life decisions and keeps your loved ones from having to guess about those choices. In essence, it will ensure that your voice is heard if you are unable to speak for yourself.
Long-term care planning
The costs of nursing home care and assisted living have skyrocketed in recent years. To understand and plan for long-term care, you must plan well in advance and take the time to learn about Medicare and Medicaid eligibility issues and coverage. At Tolison & Williams, Attorneys at Law, LLC, I help you understand and navigate the various processes and programs associated with long-term care, giving you and your loved ones peace of mind in very stressful times.

Stepchild Adoptions
When there is a biological parent still alive, those parental rights must be forfeited in order for the stepparent to begin the adoption process.
Stepparent Adoptions
A stepparent adoption formalizes the role that a stepparent has in the child’s life and brings the family together by making things “official.” Children can assume the stepparent’s surname, which can clear up confusion in school and solidify the child’s feelings of acceptance in a loving family.
Termination of Parental Rights
If there is a nonparticipative parent, such as a parent who has been incarcerated or otherwise uninvolved in the child’s life, termination of parental rights must occur before the other relative can adopt.
Trust Administration
You can use a trust to determine the disposition of your property, much like a will. Unlike a will, however, a trust is a private agreement that is effective immediately; a will is only effective the moment you die.
Trusts Attorney
Trusts are simply a type of estate planning tool. There are a variety of types of trusts, and different types of trusts may be used to accomplish different goals. In the most common estate planning scenario, the use of a revocable living trust should be considered.
Trusts Lawyer
In essence, a trust is a private agreement, a contract, between a trustmaker and a trustee. You, as the trustmaker, establish the terms and conditions under which your assets and affairs should be managed if you ever become incapacitated and/or upon your death.

Visitation Matters
Even after visitation has been established between parents, other matters may come up that cause conflict or further legal issues. Parents may blame each other for any behavior problems they have with their children and want to modify existing plans.

Our team has the skill and knowledge to handle even the most complex legal issues with regard to visitation. This includes disputes as well as grandparent visitation cases. Our firm’s ultimate goal is to find solutions that will be in the children’s best interests and work for your family.

When reading reviews, you can almost always tell if someone didn’t like the outcome of their case or if they owe the attorney money. Ms. Tolison represented me in a child support matter on two separate occasions and it was always with the utmost professionalism and sincere concern for my case. Documents to be filed with the court were reviewed, corrected and edited several times, making sure everything was exactly right. I appreciated that and my case file will no doubt reflect that. I highly recommend Ms. Tolison and her team. Thank you so much

We want to let everyone know how wonderful Katie Tolison and all of her staff are. We had the most horrific case anyone could ever imagine. Katie and her team handled our case with the highest professionalism all the while showing us kindness and compassion. Katie met every deadline on time and was always very prepared. I really don’t know how she did it so well with us, every time she talked to me I was in tears, she somehow got the information she needed to prepare all the while tenderly taking care.

Positive: Professionalism, Quality, Responsiveness, ValueI started my divorce case on my own trying to save the expense of an attorney and ended up in way over my head. After consulting with several attorneys I hired Katie and I am so glad I did. Katie helped me navigate the very complicated legal system and made sure I didn’t get taken advantage of. When things didn’t make sense to me she took the time to explain them in a way that I could understand. Every time I was frustrated or angry Katie would listen and was very supportive. She understood my feelings and helped me get back to a place where I was ready to move forward and deal with whatever issue had come up. Katie and her team were awesome! Despite me having them join the party late they got right to business in my defense. She was upfront and honest about what we can avoid to save me money if possible. She told me what was beneficial and what wasn’t. Furthermore, I was forced to drop council to pay marital bills (which she advised) as a benefit to all parties. Then offered guidance as a more cost effective option. Even after Katie called me the morning prior to a hearing as a courteous human being and directed me on what was immediately required for the hearing. She even went so far as to edit my response, file with the courts which I had no way of doing and suggested that she would only bill me an hour to prepare it. This is a huge testament to the overall integrity and professionalism of the practice which is hard to find in any profession.
