1. What is a Chapter 11 Bankruptcy? Chapter 11 permits a person or business to reorganize while obtaining protection from its creditors. 2. Who cannot file a Chapter 11? A governmental agency, estate, nonbusiness trust, stockbroker, commodity broker, insurance company, bank, or SBA-licensed small business investment company. An individual may not file under Chapter 11 if he or she has had another bankruptcy case dismissed within the last 180 days.

1. What is a chapter 13 bankruptcy and how does it work?A Chapter 13 allows a person to repay all or a portion of their debts. A person who files a chapter 13 is called a debtor. In a chapter 13, the debtor must submit to the Court a Plan for repayment of all or a portion of debts. The Plan must be approved by the Court to become effective. If the Court approves the debtor’s Plan, most creditors will be prohibited from collecting their claims from the debtor. The debtor must make regular payments to a Chapter 13 Trustee, who collects the money and disburses it to creditors in the manner called for in the Plan. Upon completion of the payments, the debtor is released from liability for the remainder of his or her dischargeable debts. 2. How does a Chapter 13 differ from a Chapter 7?In a Chapter 7 the debtor’s nonexempt property, if any exists, is liquidated to pay as much as possible of the debtor’s debts. The debtor loses all or most nonexempt property and receives a Chapter 7 discharge

In general, a qualified person or married couple will receive a discharge of their unsecured debt. A “discharge” is a Federal Court Order prohibiting the collection of a listed debt. As a result of a Chapter 7 bankruptcy your creditors are prohibited from calling, billing, suing or contacting you. Lawsuits and garnishments are stopped, no matter where they are in the court process. In some cases, repossessed vehicles must be returned.
